By accessing or using the Motorgear website at motorgear.co.nz, placing an order, or communicating with us, you confirm that you have read, understood and agree to these Terms and Conditions in full.

These terms constitute a legally binding agreement between you and Motorgear Ltd, a New Zealand registered business. We reserve the right to update or modify these terms at any time without prior notice. Continued use of the website after any changes constitutes your acceptance of the updated terms.

You must be at least 18 years of age to make a purchase from our website.

Motorgear specialises in motorcycle helmets, riding apparel, footwear, accessories and communication devices. We make every effort to display product descriptions, images and specifications as accurately as possible.

However, we do not warrant that product descriptions or other content on the site is completely accurate, current or error-free. Product colours may appear slightly different depending on your device display settings.

All products sold by Motorgear are sourced from authorised manufacturers and distributors. As the official New Zealand agent for Caberg Helmets and the Australasian agent for Octane Apparel, all products in these ranges are genuine, certified goods.

By placing an order through our website, you are making an offer to purchase the selected item(s) at the stated price. Your order is not confirmed until you receive a written order confirmation email from Motorgear.

We reserve the right to refuse or cancel any order at our discretion, including in cases of:

• Pricing errors or product description errors
• Stock unavailability after order placement
• Suspected fraudulent activity
• Failure to verify payment

If we cancel your order, a full refund will be issued to your original payment method promptly.

Orders may be amended or cancelled prior to dispatch by contacting us immediately at info@motorgear.co.nz or 0508 668 674. Once dispatched, orders cannot be cancelled.

All prices listed on the Motorgear website are in New Zealand Dollars (NZD) and include GST unless otherwise stated.

Prices are subject to change at any time without notice. The price applicable to your order is the price displayed at the time you place your order.

Shipping costs are additional and will be clearly displayed at checkout before you complete your purchase. Free shipping is available on qualifying orders as advertised on our website.

Motorgear reserves the right to correct any pricing errors, even after an order has been placed. In such cases, we will contact you before processing the order.

Payment is required in full at the time of ordering. We accept major credit and debit cards and other payment methods displayed at checkout. All transactions are processed securely using SSL encryption.

Motorgear does not store your full credit card details on our servers. Payment processing is handled by our secure payment gateway provider.

If payment fails or is declined, your order will not be processed. You will need to provide an alternative valid payment method to complete your purchase.

Motorgear ships within New Zealand only. Orders are dispatched within 24 hours of confirmed payment (Monday to Friday, excluding public holidays).

Estimated delivery times are:

• Urban addresses: 2–5 working days
• Rural addresses: 3–7 working days

Delivery timeframes are estimates only and are not guaranteed. Motorgear is not liable for delays caused by courier companies, weather events or other circumstances outside our control.

Risk of loss or damage to products passes to you upon delivery to your nominated delivery address. If your order is lost or damaged in transit, please contact us immediately so we can investigate with our courier provider.

Free shipping thresholds and fees are as advertised on the website at the time of ordering.

We offer a 30-day returns policy on unused items in original condition with all tags and packaging intact. To initiate a return, contact us within 30 days of receiving your order.

Items are eligible for return if they are:

• Unused and unworn, in original condition
• In original packaging with all tags attached
• Returned within 30 days of the delivery date

The following items are not eligible for return:

• Items that have been worn, washed or used
• Items damaged through misuse or neglect
• Sale items marked as final sale

For size exchanges, return shipping is covered by Motorgear. For change-of-mind returns, return postage is the customer's responsibility. Faulty or incorrectly supplied items — all shipping costs are covered by Motorgear.

Approved refunds are processed within 2–3 business days of receiving the returned item and will be issued to the original payment method.

Your rights under the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986 are not affected by this returns policy.

All products sold by Motorgear come with the manufacturer's warranty where applicable. Warranty terms vary by brand and product — please refer to individual product pages or contact us for specific warranty information.

Under the Consumer Guarantees Act 1993, all goods must be of acceptable quality, fit for purpose and match their description. If a product fails to meet these guarantees, you are entitled to a remedy from Motorgear.

Warranty claims do not cover damage caused by misuse, accident, modification, improper care, or normal wear and tear.

To the fullest extent permitted by New Zealand law, Motorgear's total liability to you for any claim arising from your use of this website or purchase of our products shall not exceed the purchase price paid for the relevant product.

Motorgear is not liable for any indirect, incidental, special or consequential loss or damage, including but not limited to loss of income, loss of profits, or loss of data.

Nothing in these terms limits or excludes liability that cannot be limited or excluded under the Consumer Guarantees Act 1993 or any other applicable New Zealand law.

All content on the Motorgear website, including but not limited to text, images, graphics, logos, product photographs, and design, is the property of Motorgear Ltd or its content suppliers and is protected by New Zealand and international copyright laws.

You may not reproduce, copy, distribute, modify or use any content from this website for commercial purposes without prior written permission from Motorgear Ltd.

Brand names, product names and trademarks referenced on this site are the property of their respective owners.

These Terms and Conditions are governed by and construed in accordance with the laws of New Zealand. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the New Zealand courts.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
